But ‘swear’ can mean “make a solemn statement or promise …”, but also using offending language - so what’s the count then ?
In regards to swearing an oath:
"But above all things, my brethren, swear not, neither by heaven, neither by the earth, neither by any other oath: but let your yea be yea; and your nay, nay; lest ye fall into condemnation."
-James 5:12
In regards to foul language:
"But I say unto you, That every idle word that men shall speak, they shall give account thereof in the day of judgment. For by thy words thou shalt be justified, and by thy words thou shalt be condemned."

Very ironic how courts make people swear on the Bible when it say not to swear oaths.
