Aggressive Dog?

Hey everyone, just wondering, today I was playing with a dog outside his house when another bigger neuted dog came by and caused abit of trouble. He came up sniffed and snarled a little. The other dog went into a submissive position on his back and waited. The bully then sniffed again and then pissed right next to him, practically on him abit. Is this aggression, him being dominant or just territory marking?
